Accessing Records

Clatsop Behavioral Healthcare (CBH) is committed to protecting client behavioral health information. 

Mental Health Records – Mental health records are protected under HIPAA (45 CFR, Part 164).

  • Clients may request a printed or electronic copy of their records once annually at no cost. Charges for additional copies may apply.
  • Releases to third parties require a signed, valid Release of Information form or a complete, valid subpoena

Alcohol and Drug Records  — The Substance Use Confidentiality Regulations (42 CFR, Part 2) afford alcohol and drug records additional protections.   

  • Clients may request a printed or electronic copy of their records once annually at no cost. Charges for additional copies may apply. 
  •  Releases to third parties require a signed, valid Release of Information form or a court order signed by a judge. Subpoenas do not constitute a valid request under 42 CFR, Part 2.   

Submitting a Request

Individuals requesting their own records may do so via telephone or in person at any of our clinical offices.

Third parties may request records by email, fax, or mail.

Records Content Disputes

Clients may address concerns about the content of their records with their provider or the provider’s direct supervisor. If the client feels the outcome is not satisfactory, they may file a complaint by submitting a complaint form to contactcbh@clatsopbh.org.
